Contest Terms and Conditions

Now, there may be the chance that we do not onboard enough partners or have enough to break even for this trip. If we don’t receive enough new partners or funds to conduct the drawing, we will more than happily compensate the winner with a $500 visa gift card.

Please note that if you received any of our email offers, you are only allowed to reclaim one prize per month depending on when you referred us to the person.

This event is sponsored by Captain IT. Open to those that are legal residents of the United States who are 18 years of age or older and have a valid driver’s license. Void where prohibited. Odds of winning dependent upon the number of eligible entries received during the Contest Period. The Contest is administered by Captain IT and any questions, comments or complaints regarding the Contest must be directed to the contest administrator. Entrant acknowledges that any information provided will be used for administering the Contest. Not to be combined with any other offers, Captain IT reserves the right to change the conditions of this offer at any time without notice.

Prize(s): A 2-day, 2-night trip to Disneyland Park for four will be awarded to one (1) winner. Approximate value of the trip is $4500.00. WINNER IS RESPONSIBLE FOR PAYING ALL LOCAL, COUNTY, STATE AND FEDERAL TAXES ON THE PRIZE. WINNER IS RESPONSIBLE FOR ANY PROPERTY TAXES THAT BECOME DUE AT ANY POINT. NO FURTHER COMPENSATION SHALL BE DUE AND NO DIFFERENCE IN THE PRIZE VALUE AND BUYOUT OPTION WILL BE PAID. Prizes are not transferable or exchangeable by the winner to any other entrant or any other person. The prize must be redeemed from Captain IT or its representative within 30 days of the contest Giveaway Event. If the prize cannot be awarded for any reason, Captain IT. reserves the right to substitute such prize with another prize of lesser or equal value, as determined by Captain IT in its sole discretion. One entry per person per referral. The drawing will be held when 5 Referrals have become a Captain IT client by signing up for Captain IT managed services. Captain IT will not be held responsible for anything else other than what is included in the package. Captain IT will not be held responsible for any due to damage of property, cancellation of winner, or misdemeanors cause by the winner and winner’s joining party.

Entry Eligibility: Open to participants 18 and over. All properly registered entrants are eligible to win. Owners of Captain IT are prohibited from participating in the Contest. Entrants into the Disney drawing will be deemed to have accepted these Terms and Conditions. If the referred person is an active Captain IT client, they must have an account payment status current at the time of contest drawing and must not have canceled or refunded their managed service agreement.

Contest Period: The contest period will begin on January 1^st, 2023 and continue until June 30^th, 2023. One winner will be chosen from a random draw of entries received in accordance with these Terms and Conditions. The draw will be performed by a random computer process.

Promotional Activity: The winner may be required to take part in promotional activity related to the Prize Draw and the winner shall participate in such activity on Captain IT reasonable request. The winner consents to the use by Captain IT and its related companies, both before and after the closing date of the Prize Draw for an unlimited time, of the winner’s voice, image, photograph and name for publicity purposes (in any medium, including still photographs and films, and on the internet, including any websites hosted by Captain IT and its related companies) and in advertising, marketing or promotional material without additional compensation or prior notice and, in entering the Prize Draw, all entrants consent to the same. By entering the Prize Draw, you agree to the collection, retention, usage and distribution of your personal information in order to process and contact you about your Prize Draw entry, and for the purposes outlined above.

Modification/Termination of Contest: Captain IT reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, this Prize Draw with or without prior notice due to reasons outside its control (including, without limitation, in the case of anticipated, suspected or actual fraud). The decision of Captain IT in all matters under its control is final and binding and no correspondence will be entered into.

Acceptance of Prize: By accepting the prize, Winner agrees to the prize conditions on participation and must sign a release to be eligible to receive the prize and hereby agrees: (i) that all decisions of Captain IT and Contest Entities with respect to the Contest are final and binding; (ii) to release Captain IT and its respective parent companies and affiliates, officers, owners, directors, employees, agents, and licensees from any and all claims in connection with the Contest and the award or use of the prize; (iii) to allow Captain IT to use their names, voices, photographs, likenesses, biographical material, in any advertising or broadcasting material relating to this contest, without additional financial or other compensation; and (iv) where allowed by law, sign a publicity release confirming such consent prior to acceptance of the prize. All other costs and expenses related to prize acceptance and use not specified herein as being provided are the sole responsibility of Prize winner. Captain IT is not responsible in any manner for, any warranties, representations, or guarantees, express or implied, in fact or law, relating to any prizes, regarding the use, value or enjoyment of the prize, including, without limitation, its quality, mechanical condition, or fitness for a purpose. Captain IT will not have any further obligation to winner. All taxes, upgrades and any other expenses not specifically identified in these Official Rules as included in the prize are the responsibility of the winner. Captain IT reserves the right to substitute a prize, in whole or in part, of equal or greater monetary value if a prize cannot be awarded, in whole or in part, as described for any reason. Captain IT shall not be liable for any failure to comply with its obligations where the failure is caused by something outside its reasonable control. Such circumstances shall include, but not be limited to, pandemic, weather conditions, fire, flood, hurricane, strike, industrial dispute, war, hostilities, political unrest, riots, civil commotion, inevitable accidents, supervening legislation or any other circumstances amounting to force majeure.

Tampering and Delivery Disclaimer: Captain IT in its sole discretion, reserves the right to disqualify and prohibit from participating any person, who Captain IT determines (in its discretion) is or is attempting to: (i) tamper with any part of the Contest; (ii) attempting to undermine the legitimate operation of the Contest by cheating, deception, or other unfair playing practices, (iii) intending to annoy, abuse, threaten or harass any other participants, agents or representatives of Captain IT and/or (iv) otherwise violating these Official Rules.

Other Prize and Tax Information: For each referral that becomes a client the referee will be given a $100.00 Visa gift card. Distributions from Captain IT will happen quarterly. If you receive more than two payouts annually, referee will need to complete an IRS Form W-9 and Captain IT will send referee an IRS Form 1099 for tax purposes.

Release By participating in the Contest, each participant and winner holds harmless and waives any and all claims of liability or damages against Captain IT and their respective employees and agents, for any personal injury or any loss which may occur from the conduct of, or participation in, the Contest, or from the award, receipt and/or use or misuse of any prize, including any travel related thereto. In order to participate in the giveaway event or to receive a prize, participants must sign an official waiver form provided by Captain IT below.

Compliance with Law: BY ENTERING THE CONTEST, PARTICIPANTS HEREBY SUBMIT TO THE JURISDICTION AND VENUE OF THE FEDERAL AND STATE COURTS OF CALIFORNIA, COUNTY OF RIVERSIDE, AND WAIVE THE RIGHT TO HAVE DISPUTES ARISING OUT OF THIS CONTEST ADJUDICATED IN ANY OTHER FORUM. IN NO EVENT WILL THE PARTICIPANT BE ENTITLED TO INJUNCTIVE OR EQUITABLE RELIEF OF ANY KIND, OR RESTRAIN THE CONTINUATION OF ANY CONTEST. Liability: In consideration of entering and/or attending the Giveaway, I release Captain IT, its owners, affiliates, employees, and agents from any and all claims I, or my agents or assigns may ever have, including but not limited to tort, common law and contract claims, other than any express contractual obligations of Captain IT as expressly set forth in the contest rules.
